I recently wrote an article for the Nevada Lawyer about free speech in the workplace. Many people assume the Free Speech Clause in the First Amendment protects employees from discipline by employers when employees say things their employers don’t want them to say, but that isn’t necessarily true.
My article discusses specifically whether employees in the private sector can say whatever they want without being disciplined by their employers, and it explains what type of restrictions the government places on employer speech.
